RESOLUTION 356
WHEREAS, the Board of Trustees (“Board”) of Lincoln University of the Commonwealth System of Higher Education (“University”) heretofore adopted Resolution 324_041809 on April 18, 2009 (“Board Resolution”) authorizing and approving certain matters in connection with a project consisting of the construction of a 600-bed student residence hall (the “Residence Hall Project”); and WHEREAS, HBCU Capital Financing has preapproved $40 million for the proposed new Residence Hall Project after taking into account the maximum annual debt service requirement on the previously issued $40.1 million loan to construct the 400-bed apartment-style residence hall and consolidate debt; and WHEREAS, Lincoln University established a Student Housing Initiative committee to proceed to implement the project; and WHEREAS, The University established the following desirable features for the new Residence Hall Project: (a) 50-year building, (b) 400-beds for new students, (c) 200 beds for use to renovate existing residence halls, (d) heating and air conditioning feature for provision of individual room comfort, and (e) successful bidder must have significant minority participation; and WHEREAS, Lincoln University issued RFI No. 2554 on July 8, 2009 to which 15 firms responded; and WHEREAS, Lincoln University issued Bid No. 2583 (Student Housing Initiative) to eight responders on November 5, 2009; and WHEREAS, Upon further review of the eight submitted bids, it was determined that the University could invite the three lowest bidders for further discussion on issues other than cost; and WHEREAS, Discussions were held with parties representing the three lowest bid submissions, and these firms have presented their best offers, WHEREAS, The University’s owners representative has reviewed the final three (3) proposal packages; now therefore be it RESOLVED, That the Lincoln University Board of Trustees hereby authorizes Authorized Officers of Lincoln University to begin discussions with Collegiate Development Services (Cutler) to cement a Guaranteed Maximum Price (GMP) for the construction of the proposed 600-bed Resident Hall Project, and further RESOLVED, That if the University cannot secure a final GMP within the University’s financial constraints from Collegiate Development Services (Cutler), the Authorized Officers of Lincoln University are hereby authorized to enter into discussions with one of the other finalists to cement a GMP.
